Dentist shooting suspect extradited

Following extradition to New York from Georgia, the man in custody for the brutal slaying of a Forest Hills orthodontist in front of his four-year-old daughter has been arraigned on second-degree murder charges.
Mikhail Mallayev, 50, allegedly used a crude bleach bottle and duct tape silencer to muffle the gunshots in the Sunday, October 28, 2007 killing of Daniel Malakov, 34 in the Annadale playground near P.S. 175 in Forest Hills.
“The defendant is accused of cold-bloodedly and intentionally gunning down a Forest Hills orthodontist while acting in concert with another person,” said District Attorney Richard A. Brown. “The murder was particularly heinous as it was committed in front of the victim’s young daughter. The defendant will be prosecuted to the fullest extent of the law.”
Mallayev, who is also charged with two counts of second-degree criminal possession of a weapon and one count of third-degree criminal possession of a weapon, is described as an in-law of Mazoltuv Borukhova, Malakov’s ex-wife. He has pleaded not guilty to the murder, and faces up to 25 years to life in prison if convicted.
“He’s the killer, I know it,” Malakov’s bitter father, Khaika Malakov, said in published reports. “I want to ask him how he would feel if someone killed his son.”
At his last court appearance last week, prosecutors revealed that Mallayev and Borukhova phoned each other at least 65 times before the murder, and that one of the calls was placed near the scene.
At the time of his death, Malakov was meeting with Borukhova to hand over four-year-old Michelle for a visit. He had been granted custody only the week before on October 20.
Currently, Malakov’s mother is fighting for custody of the girl.
