Gallagher expected to resign, accept plea deal in rape case

The councilman, who was arrested in August after he was accused of raping the woman in his office on Metropolitan Avenue in Middle Village, was offered a plea deal in late February by Queens District Attorney Richard Brown that would keep him out of prison and not require him to register as a sex offender, but would force him to step down from his post, the source said.

The DA had indicated that his office planned to impanel another grand jury after a Queens Supreme Court judge dismissed the indictment against the councilman in late January following a request by Benjamin Brafman, Gallagher's attorney, who contended that the councilman was asked biased questions about his City Council position and his marriage during grand jury proceedings.

Gallagher was scheduled to return to court on March 20.
