Girl Who Killed Brother Claims Self- Defense

He’s Stabbed During Wdhvn. Phone Fight

An apparent argument over a cell phone reportedly ended in bloodshed when an 18-year-old girl fatally stabbed her brother inside their Woodhaven home last Friday afternoon, Sept. 7.

Yoearis Diaz, 18, was arraigned the following day, Saturday, Sept. 8, on a second-degree murder charge for the death of 20-year-old Frank Fortuna at their home on 88th Street near 89th Avenue at around 5:25 p.m. last Friday.

According to published reports, Diaz’s attorney claimed that she became involved in a dispute with Fortuna after he accused her of stealing his cell phone.

Reportedly, the argument turned violent when Fortuna allegedly picked up a metal chain and began wailing on Diaz. Police said Diaz allegedly picked up a knife and stabbed Fortuna in the neck.

Members of the 102nd Precinct and EMS units responded to the scene moments after receiving a 911 call about the incident. Fortuna was transported by paramedics to Jamaica Hospital Medical Center, where he later died.

A short time later, Diaz was taken into custody by officers and charged with Fortuna’s murder following questioning by the 102nd Precinct Detective Squad.

Court records noted that she was arraigned in Queens Criminal Court last Saturday before Judge Gene Lopez, who ordered her held without bail. Diaz is scheduled to return to court on Sept. 21.
