The members split 12-12, with two abstentions, over an application by Temptation Nightclub Bar at 37-74 103rd St. in Corona to open in an area full of bars that draw young immigrant patrons as well as complaints from longtime residents.Arthur Teiler, co-chairman of the CB 3's Business and Economic Development Committee said the committee recommended not to approve the license, noting that Ponce was not an experienced bar owner, the location had prior violations and the prior owner and Ponce shared the same accountant.Member Arturo Sanchez thought it was unfair to deny the license to Ponce, whom he hailed as an entrepreneur.”We are saying no on the basis that there are violations he did not commit and because he has no experience? That is beyond the pale,” he said.The board's decision is only a recommendation. The final decision is made by the State Liquor Authority.Several of those opposed to the proposal noted that a state law known as the 500-foot rule, requires a public hearing if there are more than three bars within 500 feet, a condition that exists at the location. The rule requires the hearing, but does not prohibit new bars, according the State Liquor Authority Web site.Ponce, who recently bought the bar from the previous owner who was forced to close by the State Liquor Authority, was not fazed by the challenge of opening a bar with many others nearby.The Ecuadorian immigrant said he needed to support his family, including a daughter in college.”If you don't do nothing, you don't get anything,” he said.Community Board 3 District Manager Giovanna Reid said the issue could be voted on again at the next board meeting. “It is not determined how we are going to handle it,” she said.Reach reporter Adam Pincus by e-mail at news@timesledger.com or by phone at 718-229-0300, Ext. 154.
