Ernesto Marmol, 60, of 89-28 127th St., pleaded guilty to first-degree manslaughter Feb. 10 for beating Joselyn Rinc˜n, 36, with a three-foot metal pipe, causing her death inside their home on Nov. 17, 2003.”The defendant admitted his guilt, waived his right to an appeal and was sentenced to prison for beating his girlfriend to death with a metal pipe,” Brown said in a statement.”The defendant is a danger to society and I hope the prison sentence imposed today by the court gives a sense of solace and safety to his children,” Brown said. “The defendant's violent behavior made orphans of his children.”The couple's two children, a 9-year-old daughter and 5-year-old son, were sleeping when the incident occurred in the early morning hours back in November 2003 but were not physically harmed. They are being cared for by Rinc˜n's best friend, Doris Bermudes, according to an official with the DA's office. Brown said both Marmol and Rinc˜n immigrated to America “in search of the American dream” from the Dominican Republic. Marmol was known to be an abusive boyfriend, according to the official, but the 102nd Precinct could not confirm the claim.Repeated calls placed to Marmol's attorney, Garnett Sullivan, were not returned.
