The investigation into a police shooting of an armed man in Elmhurst is continuing as of Monday, December 11, a spokesperson for the New York Police Department (NYPD) said, and there is no estimated timetable for when it could be wrapped up.
Meanwhile, Wayne Bolton, the 24-year-old man who allegedly pointed a .38-caliber pistol at police, is still recovering in Elmhurst Hospital from gunshot wounds in both legs. Hospital officials said that Bolton, though running a fever, was in stable condition.
On Friday, December 8, Bolton was charged with criminal possession of both a weapon and marijuana after the incident at 9 p.m. that evening.
Bolton is being held pending arraignment for both the weapon and drug charge. He faces up to 15 years in prison if convicted, said a spokesperson for Queens District Attorney Richard Brown
According to published reports, Bolton was acting suspiciously nearby to the Queens Center Mall, when one sergeant and two officers - all in plainclothes - began to follow him in an unmarked car. When Bolton began to run, the officers followed him on foot. After pursuing the suspect into the three-story Lefrak City Parking Garage, located at 58-17 Junction Boulevard, the sergeant spotted Bolton on the second floor.
According to the police report, Bolton had his gun drawn when the sergeant fired two rounds from his service revolver, striking the man in both legs just below the knees. The police later recovered a pistol with four rounds in the cylinder at the scene.
The shooting was third in three days involving police - On Wednesday, December 6, police shot an armed, 22-year-old man in Flatbush who they said was reaching for a gun, and on Thursday, December 7, cops wounded a man who allegedly opened fire on them and their vehicles in East New York.
So far this year, police officers have shot 31 people, a figure announced by Police Commissioner Ray Kelly on Saturday, December 9, but that number is down by three people from the same period last year, Kelly said.
“I think it underscores the dangers that police officers face,” Kelly said in published reports.
