Man guilty of fatal 2005 stabbing

A Jamaica man has been convicted of fatally stabbing a neighborhood man twice in the chest during a July 2005 street fight behind a Briarwood public school.
“The defendant has been convicted of murdering an unarmed man with whom he was fighting by resorting to the use of a knife to fatally stab him through the heart. His actions will now result in his serving what will probably be the rest of his life behind bars,” said District Attorney Richard A. Brown.
Dwayne Morrison, 26, of 139-58 86th Road in Jamaica, was found guilty of second-degree murder and fourth-degree criminal possession of a weapon. Justice Randall T. Eng, who presided at trial, set a sentencing date of June 18, at which time the defendant faces up to 25 years to life.
Morrison was found guilty of fatally stabbing 23-year-old Miguel Restituyo twice in the chest with a knife in a park behind the Robert Van Wyck Middle School at 85-05 144th Street in Briarwood on the evening of July 30, 2005. The two men had reportedly been arguing minutes earlier and the victim had left the area. When he returned, Morrison engaged him in a fistfight. As the victim started to get the upper hand in the fight, an unknown individual tossed the defendant a knife. Although the victim held up his hands in surrender, the defendant stabbed him twice, including once fatally in the heart.
