The deal would also keep the councilman off the sex offender registry, the source said. It was unclear whether Gallagher would accept the deal, but Queens DA Richard Brown intends to indict the councilman for a second time in early March, the source said.
Queens Supreme Court Justice Sherri Roman dismissed rape charges against Gallagher in late January following a request by Benjamin Brafman, Gallagher's attorney, who contended that the councilman was asked biased questions during grand jury proceedings.
But Roman said that the court found sufficient evidence to support charges brought against Gallagher and gave prosecutors until March to decide whether to bring the councilman before a second grand jury.
Brafman could not be reached for comment. The DA's office would not comment Friday.
