Madoff must face jail time now

A judge ruled that money manager Bernard Madoff can remain free on bail while awaiting trial. Meanwhile, he violated his bail agreement by mailing more than $1 million in jewelry and heirlooms to family and friends over the holidays.

My question is that with all the money he allegedly stole, did it not really belong to his victims? If he was a common crook, would he not be in jail by now? What he did went beyond greed because he ruined lives.
