Fan seeking $100,000 after being punched at Citi Field

A woman is seeking $100,000 in damages after being punched at a Mets game last year, according to a Manhattan Supreme Court summons filed Monday.

Danielle Nero, 33, is suing 54-year-old John Seltzer, of East Meadow, for allegedly punching her following an argument at a Mets-Phillies game at Citi Field on Aug. 28, 2016.

According to the summons, Seltzer struck and punched Nero in the face “without provocation,” and as a result of attack, Nero suffered substantial pain and bruising. Nero alleges she also suffered permanent injuries including “tearing of her eardrum, ear infections, permanent hearing loss, and recurring vertigo.”

Seltzer pleaded guilty in January to assault and harassment and received a conditional discharge and order of protection. Nero’s lawyer, Jon Jekielek, said the outcome of the criminal charges was extremely disappointing.

“Mr. Seltzer received a slap on the wrist after he brutally assaulted Mrs. Nero while she was with her family at the Mets game,” he said in a statement. “Fortunately, Mrs. Nero is able to seek justice in civil court, by filing this action she is standing up for herself and other women who have suffered abuse at the hands of a man.”

Nero is suing for civil assault and battery. According to the summons, she is seeking $25,000 in lost wages and medical bills and $75,000 for pain and suffering.
