College Pt. contractor gets 5-year probation sentence

By Ayala Ben-Yehuda

The last contractor convicted of dumping illegal construction waste on the College Point ballfields was sentenced Tuesday to five years’ probation and $25,000 restitution, law enforcement officials said.

Russell Marisak of Brooklyn was president of Enviro-Fill, a Flushing company hired in 1995 to renovate the ballfields at no charge to the College Point Sports Association in exchange for accepting clean fill.

Marisak was convicted of taking part in a scheme to dump construction waste such as pipes and concrete onto the ballfields.

Francesco Casalino of Malverne, L.I. and his brothers Anthony and Joseph Casalino of Howard Beach, who operated trucking and demolition companies, were sentenced in January for their role in the dumping.

Enviro-Fill’s vice president, Benjamin Rastelli, was sentenced to three months of weekends in jail and $250,000 in restitution in September.

The illegal debris took years to remove after the city took control of the park from the College Point Sports Association. In October the city sued the association, the Casalinos, Enviro-Fill, Marisak and Rastelli to recover $16 million in costs associated with cleaning up and building the ballfields.
