Diana Reyes, the mother of the 12-year-old boy critically injured in an October 22 drunk driving incident, has filed a $50 million suit against the driver in civil court.
The driver, John Wirta, who is accused of killing Vasean Phillip Alleyne, 11, and critically injuring Angel Reyes, 12, after driving drunk, had his day in Queens criminal court this week. The 58-year-old faced Alleynes distraught mother, Monique Dixon, as she angrily accused him of destroying a family.
"My son cant walk around anymore he shouldnt be allowed to walk out of the courthouse," said Dixon. "My pain is so great that Im numb parents are not supposed to bury their children."
"I can only pray that the District Attorneys office and investigators investigate thoroughly so they can prove he has another negligence so he can face felony charges," said Dixon.
But little can mend the heartache of the two families whose lives were irreversibly changed on October 22. Free on $5,000 bail, Wirtas possible sentence of one year in jail and a monetary fine may be upped according to prosecutors, pending further investigation into the crime. A return date of November 22 for Wirta has been set.
Politicians are calling for legislation called "Vaseans Law," which would make all fatalities resulting from drunk driving a felony.
"This is a fitting memorial," said Dixon. "A law lasts forever my sons name will be spoken forever."
