KEW GARDENS — A 30-year-old Ozone Park woman who provided care for children out of her home was convicted Tuesday of reckless assault of a child by a daycare provider in the June 2009 death of an 11-month-old boy who drowned in a bucket with 6 inches of water, Queens District Attorney Richard Brown said.
Kristal Khan, 30, of 101-27 108th St. in Ozone Park, took Nyquil at around 6 a.m. June 15, 2009, while caring for the child even though she knew one of the side effects of Nyquil is drowsiness, Brown said.
Later that morning, 11-month-old James Farrior was moving about a room in Khan’s home as Khan fell asleep, despite her knowing that a bucket of water was left unattended and could be hazardous to children, the DA said.
Khan’s 4-year-old child woke her up later that morning and Khan discovered the baby in the kitchen with his upper body submerged in the bucket, Brown said.
Khan was convicted Tuesday following a six-day jury trial in Queens Supreme Court.
Queens Supreme Court Justice Richard Buchter set Khan’s sentencing for March 28. She faces up to four years in prison.
