FAR ROCKAWAY — Two Far Rockaway men were charged with robbery and assault after they allegedly tried to steal a gun from an undercover officer walking on the boardwalk, a spokeswoman for Queens District Attorney Richard Brown said.
The undercover was walking his dog on the boardwalk in front of 138 Beach 27th St. around 6:20 p.m. Oct. 22 when another teen pointed to what appeared to be a real gun — but was in fact an imitation pistol — into his stomach and told him to “give it up,” according to the criminal complaint.
As the officer chased the minor, he was confronted by David Caraballo, 21, and Davone Torres, 19, both of Far Rockaway, who told him, “Where the gun? Give up your gun, we know you have a gun,” the complaint said.
Caraballo then allegedly reached into the officer’s pocket and took away the imitation pistol, the complaint said.
The officer then pulled out his gun and identified himself as police when a struggle for the weapon ensued, the complaint said.
Torres and Caraballo then allegedly grabbed the gun, bent the officer’s hand backward, causing the pistol to be pointed in their direction, the complaint said.
The pistol discharged and fired off a round that passed the officer’s ear, another struggle occurred and the officer fired off shots in the direction of the men, who fled the scene, the complaint said.
Caraballo and Torres were arraigned Oct. 24 by Queens Criminal Court Judge John Zoll on charges of robbery and assault, the spokeswoman said.
Their bail was set at $50,000 apiece and they are next scheduled to appear in court Monday, the spokeswoman said.
