A career burglar who was shot in the buttocks during a failed burglary attempt in Maspeth last year has been sentenced to 16 years to life in prison, Queens District Attorney Richard Brown announced.
Felix Perez, 38, of Crown Heights, Brooklyn, was sentenced to the term after pleading guilty to second-degree burglary charges in September before Queens Supreme Court Justice Ira Margulis.
The charges were brought against Perez for a failed burglary attempt on Aug. 1, 2016, in a first-floor apartment at 55-38 66th St., off of Hull Avenue in Maspeth, where police responded to a 911 call of a burglary in process and found Perez hiding in a back room.
A physical altercation took place as Perez struggled with a cop over his gun. The officer then discharged one round from the service weapon and struck Perez in the buttocks/groin area. He then fled the scene, but was quickly apprehended approximately a block away from the house.
“The defendant, a persistent felon, violated the sanctity of another person’s home in order to enrich himself,” Brown said. “He has now been sentenced by the court to a lengthy term of incarceration as punishment for his actions.”
Following the incident, Perez turned around and sued the city for $10 million claiming the shooting gave him post-traumatic stress disorder (PTSD), back in February. He took his case to Manhattan Federal Court where he represented himself as his lawyer.
It is unclear, however, if the city has viewed his complaint.
