The alleged gunman and reputed MS-13 member behind Sunday’s deadly broad daylight shooting at the 90th St – Elmhurst Avenue train station is facing life in prison after being charged with murder and other offenses.
Ramiro Gutierrez, 26, could receive a sentence of 25 years to life in prison if he is convicted on charges that include second-degree murder, gang assault, and criminal possession of a weapon in the shooting death of 20-year-old Abel Mosso the DA’s office announced yesterday.
Gutierrez, and others who have yet to be identified by authorities, were allegedly beating Mosso aboard the 7 train, and “dragged him” onto the platform at the 90th Street station to continue the beating just before 1 p.m. on Feb. 3, the DA said.
Police said the alleged shooter and victim, who is believed to be a member of the 18th Street gang, were disputing on the Manhattan-bound train before the fight spilled onto the platform.
A graphic, viral video of the incident caught the scuffle on the platform, where five to six shots can eventually be heard.
Mosso was shot several times in the face and head, according to police and the DA, and was pronounced dead at the scene by EMS.
While police say the alleged shooter and victim are from rival gangs, the cause of the fight had not been determined.
Queens District Attorney Richard Brown called the shooting, “a cold blooded murder.”
“This senseless act of gun violence by an alleged member of a vicious street gang will not be tolerated in Queens County. The defendant now faces the prospect of spending the rest of his life locked behind bars,” he said.
Police are still searching for two suspects in connection to the incident.
