Three reputed MS-13 gang members have been indicted on murder charges for the brutal slaying of a man on the 90th Street-Elmhurst Av subway platform in broad daylight on Sunday, Feb. 3.
“Gang activity, such as this brazen mid-day attack, will not be tolerated in Queens County,” said John M. Ryan, Chief Assistant Queens District Attorney. “The defendants took the life of a young man on the train platform in front of many onlookers without any hesitation or care.”
The defendants, all from Flushing, have been identified as Ramiro Gutierrez, 26, Victor Lopez, 20, and Tito Martinez Alvarenga, 19. They were arraigned today and each indicted on two counts of second-degree murder, first- and second-degree kidnapping, first-degree gang assault and second-degree criminal possession of a weapon.
They were remanded into custody and ordered to return to court on June 11. If convicted they face 25 years to life in prison.
The defendants allegedly beat Abel Mosso on the 7 train, then dragged the 20-year-old onto the platform at the 90th Street-Elmhurst Av station and continued to punch and kick the victim. During the fight, Gutierrez allegedly was able to escape from the melee, before standing up with a firearm and shooting the victim six times.
Gutierrez was arrested less than 24 hours after the shooting. Lopez and Martinez Alvarenga were arrested on Feb. 21.
Mosso, believed to be a member of the rival 18th Street gang, was pronounced dead at the scene. The incident was caught on video by a straphanger and the defendants were identified via still images.
