A reputed gang member could spend the rest of his life in prison for fatally shooting a man in broad daylight at a Jackson Heights train station.
Ramiro Gutierrez, 26, was arrested on Feb. 5. He is currently awaiting to be arraigned on charges of second-degree murder, first-degree gang assault and second-degree criminal possession of a weapon.
If convicted, Gutierrez faces 25 years to life in prison.
“This was a brazen mid-day attack that started with an alleged gang assault on a train. The beating spilled out onto the platform and turned into a cold-blooded murder when the defendant allegedly shot the victim numerous times in the face,” said District Attorney Richard A. Brown. “This senseless act of gun violence by an alleged member of a vicious street gang will not be tolerated in Queens County. The defendant now faces the prospect of spending the rest of his life locked behind bars.”
According to charges, at 12:45 p.m. on Feb. 3, Gutierrez, who is an alleged member of the MS-13 street gang, and unapprehended others began to beat up 20-year-old Abel Mosso while on the 7 train. When the train pulled into the 90th Street subway station, Gutierrez and the others allegedly dragged Mosso on to the platform and continued the beating.
Video recorded by a straphanger, prosecutors say, allegedly shows Mosso being repeatedly punched during the assault.
Charges say that Gutierrez then allegedly pulled himself away from the altercation and stood with a firearm in his hand as the victim began to stand up. In the video, the shooting occurred just off camera, but the distinctive popping sounds of the gun firing six times can be heard.
Mosso, who is believed to be a rival gang member, was shot several times in the face and head.
EMS responded to the location and pronounced Mosso dead at the scene. Gutierrez allegedly identified himself in a still taken from the viral video.
